Behtar Technology Private Limited operates and owns the platform with the brand name ‘SahiJobs’, (hereinafter to referred as “we” or “us” or “our” or “company” or “Platform”). These Terms & Conditions, along with the other terms constitutes the Platform  Policies (including the Terms & Conditions, Privacy Policy & Refund Policy) and creates a binding agreement by and between Us and You (hereafter referred to as “you” or “your” or “users”) governing your use of our website, goods (as applicable) or Mobile App or services (as applicable) (referred to as “Services”.)
By using our Mobile App and availing the services thereof, you agree that you have read and accepted the Terms & Conditions including the Platform Policies. We reserve the right to modify and update these Platform Policies at any time and without assigning any reason. It is your responsibility and we expect you to periodically review these Platform Policies to stay updated and informed.

By accessing and using ‘SahiJobs’ and avail the Services thereof, you agree to comply with and be bound by the Terms & Conditions including the Platform Policies. If you do not agree, please do not use the platform.

1.      User Registration and Account Responsibility

·       To access and use the Mobile App while availing the Services, you must create a registered account.

·       Upon the creation of your account, you agree to provide accurate, updated and complete information to us and regularly update the information after creation of your account as and when applicable.

·       You are entirely responsible for the usage on the Mobile App through your account and maintain the confidentiality of your login credentials and the information accessible through your account.

·       You are required to notify us immediately of any unauthorized use or access or security breach incident related to your account.

·       You are prohibited from using another person’s account on the platform to avail the Services. 

2.      Use of the Platform and Services

·       The Platform connects you with potential employers. The Platform shall duly verify the advertisement posted by the potential employers, however, the use of the Platform by you is completely at your own risk and the information/ advertisement are on “as-is” basis.

·       You are allowed to apply for a total of job postings/ advertisements per day as displayed on the Mobile Application during your access of the Mobile Application and/or platform during the trial period and upon the commencement of your subscription period. 

·       You are allowed and enabled to view unlimited job postings/ advertisements per day during your access to the Mobile Application and/or platform.

·       The Platform’s content/ information/ advertisement is its own proprietary. You acquire no intellectual property rights on the content/ information/ advertisement or Services of the Platform.

·       You hereby agree to not use the Platform for any unlawful purposes or in violation of any law of the country.

·       You agree to comply with all applicable laws, including without limitation privacy laws, intellectual property laws, anti-spam and regulatory requirements.

·       You agree to use the Mobile App and Services in a safe, inclusive and respectful manner and adhere to the Terms & Conditions as well as Platform Policies.

3.      User Content

·       Upon the creation of the account, you shall create your profile and shall/may submit the details including but not limited to your name, gender, age, education qualification, job experience, resumes, cover letters, preferred roles, skillset, courses or certifications, preferred languages, preferred place of employment, assets and other data (referred to as “User Content”).

·       You are solely responsible for the accuracy of the User Content submitted by you upon the profile creation. Any content that is false, misleading or violates third-party rights is prohibited on the Platform.

·       You consent to the usage of the User Content by the Platform for the purposes of operating, promoting, improving and delivering the services of the Platform.

·       The Platform at its own discretion reserves the right to remove or disable any User Content that violates the Terms & Conditions including the Platform Policies without notice.

·       To the extent permitted by law, you agree to indemnify and hold harmless SahiJobs, its owners, operators and affiliates from any claims, liabilities or damages arising from the use of the Service of any Third-Party content.

4.      Job Postings

·       SahiJobs shall post the job vacancies on the Platform and/or Mobile App subject to the verification of the advertisement posted by the prospective employees.

·       We shall undertake the verification of the advertisement/ posting with due diligence including the registration documents among others.

·       Upon the due verification of the advertisement posted by the prospective employees you shall be able to view the relevant postings as per your requirements.

·       We do not guarantee any interview and/ or employment opportunities to you with respect to the postings on our Mobile App and/ or platform. Your interview and/ or employment opportunity shall be dependent on the requirement and/ or satisfaction and/ or availability of the advertiser.

5.      Restricted Activities

·       You are not allowed to use the Platform to harass and/or discriminate against others.

·       You are prohibited from engaging in fraudulent or deceptive or spamming activities.

·       You consent to not misrepresent your identity, qualification, employment details or any other affiliated relevant information.

·       You are not allowed to develop, support or use software, devices, scripts, robots, other types of mobile code or any other means or processes (including crawlers, browsers plugins and add-on or other technology) to scrape or otherwise exfiltrate from SahiJobs or its Services, or copy details of the advertisement and other data from the Mobile App.

·       You are restricted and prohibited to use the Services including but not limited to the details of the advertisement of the Platform for commercial purposes.

·       You are prohibited from copying, reproducing, publishing, adapting, distributing, transmitting, displaying or otherwise exploiting any content of the Platform for any purposes other than in terms of the Platform Policies. All rights not expressly granted in relation to the Services are reserved by SahiJobs.

·       You must not circumvent, disable, or interfere with any security features of the Service or functionalities that restrict or prevent the use of the Services of the Platform.

·       You are prohibited from collecting or harvesting identifiable information such as Name of the advertiser company,  preferred location, preferred roles, salary range, job description among others available to you from the usage of the Mobile App while availing the Services of the Platform.

6.      Intellectual Property

·       Your use of the Mobile App is and at all time shall be governed by and subject to the laws regarding copyright, trademark, patent and trade secret ownership and use of intellectual property. You agree to abide by laws regarding copyright, trademark, patent and trade secret ownership and use of intellectual property and you shall be solely responsible for any violations of any laws and for any infringements of any intellectual property rights caused by your use of the Mobile App through your device.

·       The Platform owns all intellectual property rights to the Platform or Mobile App or Services including the trademarks, device marks/ logos, software/technology and content, excluding User Content. We own all the copyrights in relation to the Mobile App.

·       Any intellectual property which is not specifically mentioned to be owned by SahiJobs is owned by their respective owners and the owners have a right to take appropriate actions against you for any violation, infringement or passing off.

·       We respect the intellectual property rights of others and do not hold any responsibility for any violations of any Third-Party’s intellectual property rights by you.

7.      Privacy & Data Processing

·       In order to learn more about how SahiJobs collects, uses and shares your personal information, please refer to our Privacy Policy[L2] . Your use of the Mobile App signifies your consent to our handling of such information in accordance with the Privacy Policy.

8.      Third-Party Links & Services

·       The Mobile App and/or platform may contain links to third-party websites and/ or services. These are only provided for your convenience and we do not endorse or control these external sites.

·       Your interactions with Third-Party are solely between you and the Third-Party are at your own risk and discretion.

9.      Payment Terms

·       SahiJobs offers the subscription-based model for the purposes of availing the Services on the platform. The payment for the subscription for availing the Services is within the app (In-App Purchases). By choosing to make an In-App Purchase, you acknowledge and agree that additional terms specific to the purchase, disclosed to you at the time of transaction may apply and are hereby incorporated into these Terms & Conditions.

·       You can make an In-App Purchase using the following methods: (i) through a third-party platform such as different wallets (including Razorpay, Cashfree etc.) or (b) paying with your credit card, debit card or net banking, processed by a third-party payment processor. Upon completing an In-App Purchase, you authorize us to charge your selected payment method. If payment is not received from your chosen payment method, you agree to promptly settle all outstanding amounts upon request on behalf of us.

·       The validity of the subscription shall be thirty (30) days from the date of activation of the subscription model upon the payment of the amount as displayed on the Mobile Application.

10.  Taxes

·       If SahiJobs determines it has a legal obligation to collect tax from you in connection with these Terms & Conditions, we will collect such tax in addition to the payment required under clause 9.

11.  Account Termination/ Suspension

·       Your account and your access to the Service will be terminated or suspended if under appropriate circumstances it is determined that you are a repeat offender of the Platform Policies.

12.  Warranty and Representation Disclaimer

·       Your use of the Mobile App and Services is entirely at your own risk. To the maximum extent permitted by law, SahiJobs, its directors, employees and agents disclaim all warranties, whether express or implied, related to the Services and your use of the Services. This includes but is not limited to the warranties, conditions, terms or representations about the accuracy and probability of the chances of your employment pursuant to your job application for a particular advertisement/s.

·       To the fullest extent permitted by law, SahiJobs assumes no liability or responsibility for the unauthorized access of your Account from our secure servers and any personal or financial information stored therein.

·       SahiJobs assumes no responsibility of the interruption or cessation of transmission from our Services including but not limited to the transmission of the bugs, viruses, trojan horses, or other harmful elements through the Services by Third-Party.

·       SahiJobs does not warrant, endorse, guarantee or take responsibility for any product or service advertised or offered by a third party through the Services, any linked services, or featured in advertisements/ banners for marketing purposes. We absolve from any liability and/or responsibility for monitoring any transactions between you and third-party providers of products or services.

·       The Services are operated by SahiJobs from its facilities in India. SahiJobs makes no representation about the suitability or availability of the Services in other locations. Your access to the Services outside India is at your own discretion and you are responsible for compliance with applicable local laws.

13.  Limitation of Liability

·       The limitation of the liability applies regardless of the legal theory on which the claim is based, including warranty, contract, tort or otherwise and regardless of whether SahiJobs has been advised of the possibility of such damages. In jurisdiction where certain warranties, disclaimers or conditions cannot be legally excluded, SahiJobs limits its liability under such provisions to either re-supply the Services or covering the cost of re-supplying the Services to the extent permitted by law.

·       By using the Mobile App and availing the Services thereof, you waive any and all claims against us. Some states may not allow the exclusion or limitation of implied warranties or certain types of damages, so these provisions may not apply to you. If any part of this limitation of liability is deemed invalid or unenforceable our total liability shall exceed upto the amount you have paid six (6) months prior to the cause of action.

·       The limitation of liability is an essential part of the present agreement and represents a fair distribution of risk. The Mobile App and platform would not be provided without these limitations and you agree that they survive the termination of your Account and/or access to the Service of the Mobile App and/ or platform. This disclaimer does not affect liability for fraud, fraudulent misrepresentation or other liability that cannot be limited under applicable law.

14.  Indemnity

·       To the extent permissible under the applicable law, you agree and consent to defend, indemnify and hold harmless SahiJobs, its owner/parent company, directors, employees or agents from any claims, damages, obligations, losses, liabilities, costs or expenses (including but not limited to the attorney’s fees) arising from

                                                              i.      Your use of/or access to the Service.

                                                            ii.      Your violation of these Terms & Conditions including the Platform Policies.

                                                          iii.      Your infringement of any Third-Party rights, including intellectual property rights or privacy rights.

·       The indemnification obligation will survive the termination of your use of the registered Account and access to the Services of the Platform.

15.  Eligibility

·       You affirm that you are at least 18 years old or have necessary parental/ legal guardian consent if younger.

·       Use by persons under 13 years of age is prohibited.

16.  Governing Law & Jurisdiction

·       These Terms & Conditions shall be governed by the laws of India. The Courts of Bangalore, Karnataka shall have the exclusive jurisdiction over any disputes arising under these Terms & Conditions and Platform Policies.

·       You and SahiJobs (Parties) agree and consent to first mediate any disputes or claims between us in good faith and resolve the disputes amicably.

·       You agree and consent that you will not file or participate in a class action against us.

17.  Changes to Terms

·       SahiJobs reserves the right to modify or discontinue any aspect of the Services at any time without any prior notice.

·       SahiJobs reserves the right to modify or replace these Terms & Conditions at its sole discretion. If the changes are material, we shall make reasonable efforts to provide at least fifteen (15) days’ notice before they effect.

·       Your continued use of the Service after revisions indicate your agreement to the updated terms. If you disagree with the new terms, you must stop using and availing the Services.

18.  Miscellaneous

·       These Terms & Conditions which may be updated periodically constitute the entire agreement between you and us, superseding all prior agreement, representation and arrangements between us (whether written or oral), except for the Privacy Policy. This clause does not limit or exclude liability for fraudulent misrepresentation.

·       SahiJobs has taken reasonable measures to ensure accuracy, authenticity and completeness of the information provided on the Mobile App presenting it on “as is” and “as available” basis.

·       Communication between you and us may occur electronically, whether through the Mobile App, SMS, Email or posting within the App. By using the Mobile App, you (i) consent to receive communications from the Mobile App electronically, and (ii) agree that all terms, agreement, notices, disclosures and other communications provided by us electronically satisfy any legal requirement that such communications be in writing.

·       If any provision of these Terms & Conditions including the Platform Policies is declared illegal, invalid or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed and deleted. The remainder of the Terms shall continue in full force and effect and remain binding and enforceable.

·       No failure or delay in exercising any right, power or privilege under these Terms & Conditions including the Platform Policies shall operate as a waiver nor shall any single or partial exercise of any right, power or privilege preclude any further exercise of that right of the exercise of any other right, power or privilege.

·       These Terms & Conditions and any rights or access granted hereunder may not be transferred or assigned by you but may be assigned by us without restriction.

·       In the event of any discrepancy between the English language version and any translated copies of the Terms & Conditions and the Platform Policies, the English version shall prevail.

SahiJobs may share your information with law enforcement or other authorities if required to do so by law, or if we believe it is reasonably necessary to:
i. Responded to a valid to a valid legal request.
ii. Protect the right, safety or property of SahiJobs, its users or the public.
iii. Prevent fraud, misuse or security risks.
